There are many reasons a parent may choose to move away, including a job opportunity, a life event, or a new relationship. This can cause some issues when parents are divorced and they share child custody. If your custody order has a geographic restriction, you will need to file for relocation and petition the court to have the restriction lifted or modified.
There is nothing under Texas law that specifically sets a geographic distinction for what constitutes a relocation. Typically in the Dallas-Ft. Worth Metroplex, the court will consider a relocation as cities outside of DFW and contiguous counties. From there, the court will look at all issues, including who is paying support, the relationships with both parents, opportunities for the child outside of the region, and how the relocation will affect ongoing and continued relationships. Ultimately, the court will consider what is in the best interests of the child when making a final decision.
